- Title:
- Record of a court case between Canonsleigh Priory and the parishioners of Morden
- Scope & Content:
-
Record of a court case between the abbess and convent of Canonsleigh Priory, Devon, and Thomas Chaplain, William Holbele, John Partridge and others of the poor of Morden, Dorset. The case was held at Salisbury Cathedral by John Maydenheth, Vicar-General of the Bishop of Salisbury, in the consistory court of Salisbury. The roll preserves copies of the key documents, including the testimony of the parishioners and the priory, via their attorneys, and Maydenheth’s ruling.
In a dispute that had lasted since at least 1332, the parishioners claimed the priory had failed to keep to the terms of their appropriation of Morden church. The priory had failed to make a charitable distribution of 20s annually charged upon the rectory, had refused parishioners their customary right to cut wood in the cemetery, and had uncanonically divided the church and its fruits with a layman. On 18 January 1392, Maydenheth ruled in the parishioners' favour regarding the 20s and the abbey was fined £10 which was to be paid to the poor of Morden.
Endorsed: in a late 16th-century hand, ‘Auncient p[ro]cess in the spirituall / courte concerning the convente / of Canon : Leigh’ (membrane 7d).
