JACOB EMERIX: Treatise on the Sacra Rota Romana; late 17th cent. Latin. Copy. Jacob Emerix de Mathiis (1626-1696) was Auditor of the Rota from 1668 and was elected Dean in 1687. His treatise relates to the procedures followed in the Sacra Romana Rota which dealt with civil cases within papal lands. It also outlines privileges granted to the members of the Rota. Another copy in Add. 8469. Published by C. Lefebvre in A. Agustin, Praxis Rotae et J. Emerix, Tractatus seu notitia Sacrae Rotae Romanae. Deux traités inedits sur la procédure de la Sacre Rote Romaine, publiés avec traduction, notes et compléments divers par C. Lefebvre (Tournai, 1961), pp. 28-178. Title (f. 1) 'Tractatus seu Notitia Sacrae Rotae Romanae'. Preface (f. 5) 'Notitia Sacrae Rotae Romanae / Proemium / Cogitantem et attentius mecum evolventem', inc. (f. 6) 'Liber Primus / Titulus Primus / De origine et antiquitate Sacri Auditorii / Sacri Palatii Apostolici Auditorium esse antiquissimum', expl. (f. 108v) 'et singula libenter submittens saniori iudicio et consensui'. Text divided into two parts, the first subdivided into 37 chapters or titula, the second into twelve chapters. Contemporary table of contents (ff. 2-4) entitled 'Index titulorum in praesenti Tractatu existentum'. 18th-cent. ownership note (f. 1) 'Ex libris Abbate P. Felicis de Paulinis'. Old shelfmark in ink '27' in fifth spine compartment. Owned by Frederick North, 5th Earl of Guilford, but lacking his armorial bookplate. '197' in pencil in upper left corner of front pastedown. Purchased, together with 8466, 8469, 8470, and 8473, from R. H. Evans, 8 December. 1830, lot 197 (part).
Paper; ff. 108+i, plus 29 unfoliated blanks after f. 108. Old pagination in ink '1-206' (ff. 6-108v). 270 x 197mm. Horizontal catchwords on each leaf. One Italian hand. 18th-cent. Italian binding of full vellum; edges mottled in blue; gilt-tooled title 'Notitia Sacrae Rotae Romanae' in 2nd spine compartment.
