- Title:
- Risale fi mefhumi’l-feraiz - رساله في مفهوم الفرائض
- Scope & Content:
-
This volume contains a detailed treatise on the apportionment of legacies according to the Hanefi school of jurisprudence. As with most works on this subject, a substantial amount of it comprises detailed tables indicating the proportions to be received by various heirs.
As is common in feraiz treatises, parts of the text are in Arabic. No author’s name is mentioned. The title of the work as given in the present manuscript is unusual in its form; no other feraiz manuscript with the same title has been traced.
Begins:
Besmele, el-Hamd ... ve’s-salat ... ve ba‘d, fe-hazih risale fi mefhumi’l-feraiz, tereke: meyyite hukuk-ı erba‘a-i mürettebe talik eder: techiz u tekfin, kaza-i düyun, tenfiz-i vasaya bi’s-sülüs, kısmet beyn el-verasa bi’l-Kitab ve’s-Sünne ve icma‘i’l-ümme
Ends:
ve kıyametü’l-ahir elfen ve mi’e ve isleyn (sic, i.e. isneyn) ve ‘işrun dirhemen ve evsa bi-‘itkihima la male lehü sivaha
The copy is undated, but is likely from around the 12th century AH/18th century CE.
