Copley. Hilary Term. Abstract of a Plea by Henry Pole and Alice his wife, by Thomas Hunt, their attorney, and John Babyngton, esquire, against Robert Wode and Isabel, his wife, regarding 10 tofts, 100 acres of land 40 acres of ..., ... meadow, 100 acres of woodland in Radbourne, which Sir William Dethek, knight, grandfather of the said Alice, and great-grandfather of the said John, whose heirs they are, had granted to Reginald Dethek his son, and his heirs male, remainder to Thomas Dethek and Roger Dethek, brothers of the said Reginald; and that after the death of the aforesaid Reginald, Thomas and Roger without heirs living, the lands ought to have descended to the said Alice and John because of the said grant; and also they say that the said William was seized of the said premises in the reign of Henry IV and granted the same in tail as aforesaid, and that the said Reginald and Thomas, and Thomas son of Thomas were also seized of the same, and that Thomas the son and Roger died without heirs maleand so the lands descended to Robert Dethyk, as son and heir of the said William Dethyk, and then descended to Alice, one of the petitioners, and a certain Isabel as his daughters and heirs, and by right descended from the said Isabel, who is dead, to John Babyngton, another of the petitioners, as her son and heir; And Robert and Isabel by William their attorney say that the said William did not grant the lands in tail to the said Reginald, Thomas and Roger. The said Henry, Alice and John to be in court the Octaves of St John the Baptist, etc.
