Indenture of Agreement between John Agarde of Smerrill Grange, co. Derby, gentleman, and William Agarde of Parwich in the same county, gentleman, wherein the said John will before the feast of St Michael the archangel next coming, levy a Fine 'sur conizans de droit come eco qil ad de loure donc' to the said William upon all lands and messuages [described] being in Parwich aforesaid, granted to the said William by Charles Agard esquire, father of the said John and William, to the use of the said William and his heirs males, successive remainders George, Charles, Henry Agarde, third, fourth and fifth sons of the said Charles, and in default of issue to the said Charles the father; nevertheless it is the intent that during the life of Charles the father, the said lands be subject of an agreement made between the same Charles and Henry Agarde of Dunstall, co. Staff., gentleman, concerning the said lands in default of the payment of £15 annually to the same Charles, as appears by a deed dated 31 October 4 James I, and as concerns certain lands of an annual value of £25 to the use of Elizabeth, now wife of the said William Agarde, for her jointure for life, with remainder after her death as above.
