Conveyance by Sir Thomas Brudenell, knight and baronet, lord Brudenell of Brudenells and Stenton, and Robert Huett of Ampthill, co. Bedf., esquire, to Thomas Hopkin of Nether (Lower) Thurvaston, and Thomas Trubshawe of Over Thurvaston, in co. Derby, yeomen, of a messuage and farm in Nether Thurvaston; and reciting that Whereas Sir Henry Shirley, Bart., late of Staunton Harold, co. Leic., deceased, was seised as of his manors of Shirley, Brailsford, Edlaston and Hoon, co. Derby, and of divers messuages and lands in Shirley, Brailsford, Edlaston, Hoon, Longford, Bubton, Hollington, Yeaveley, Rodsley, Wyaston, Burrowes, Thurvaston and Bradley, by a deed of revocation dated 8 May 12 James I, according to a power by him given in and by a deed bearing date 10 May 13 James I, and made between Sir George Shirley, Bart., father of the said Sir Henry, the said Sir Henry by name of Henry Shirley esquire, son and heir apparent, and Thomas Shirley esquire, second son of the said Sir George of the one part and Richard [Bourke or de Burgh] earl of Clanricarde, Sir Francis Vane, knight of the Bath, Sir Henry Yelverton, knight, then his majesty's Solicitor General, Sir Richard Farmer, knight, and Sir Basil Brooke, knight of the other part; and Whereas the said Sir Henry Shirley by his deed bearing date 9 May 20 James I made between him and the said Thomas lord Brudenell by the name of Sir Thomas Brudenell of Deane in co. Northt., Edward Stanford, the said Robert Huett, Francis Plowden of Aston in the Walls, co. Northt., esquire, did covenant to levy a fine of the said manors to the same in trust to the uses mentioned; That is to say, as to the manors and lands of Brailsford and Shirley, and lands in Elvaston, the farm in the tenure of John Johnson of Longford, the farm in Hoon, the demesne of the manor of Elvaston, the farm in Shirley, to the use of the said Sir Henry for life and after his death to the use of Lady Dorothy, wife of the said Sir Henry for life (if Dame Dorothy, late wife of the said Sir George Shirley shall so long live), with divers remainders; and as to the residue of the said manors, to the use of the said Sir Henry for life and after his death to the said Thomas lord Brudenell, Edward, Francis and Robert, to the use of the will of the said Sir Henry, and to pay the debts of the said Sir Henry and of Sir George Shirley, which are mentioned in the last will of the said Sir George; and Whereas afterwards in Easter term, 20 James I, the said Sir Henry did levy a fine to the uses aforesaid; and Whereas the said Sir Henry Shirley by his deed bearing date 21 March 4 Charles I, and by his last will dated 5 September 5 Charles I, has appointed several sums of money 'amounting to a very great value'; and Whereas the said Francis Plowden by deed dated 29 November 9 Charles I has quitclaimed his right in the premises, since which time the said Edward Stanford is dead; Now the said Thomas lord Brudenell and Robert Huett, with the consent of Robert [Devereux] earl of Essex and viscount Hereford, lord Ferrers of Chartley, Bourchier and Loveine, uncle and guardian of Sir Charles Shirley, Bart., son and heir of the said Sir Henry, contained in a deed dated 26 May, the better to enable them to pay his debts and legacies, and according to a decree in the Court of Wards and Liveries made Michaelmas aterm, 9 Charles I, 1633, and in consideratin of the sum of £686 paid by the said Thomas Hopkin, deliver to the said Thomas Hopkin and Thomas Trubshawe the messuage in Nether Thurvaston now in the tenure of the said Thomas Hopkin and all those lands pertaining to the the same, and common of pasture in Nether Thurvaston, Burrowes, and in Calland Moor and Coaland Green for all manner of cattle as of ancient time has been used to the said messuage or the mansion house in Nether Thurvaston.

Endorsements: Sealed and delivered in the presence of: F. Huett, Millicent Herenden, Thomas Steedman, Francis Steedman and William Hopkins. Memorandum that whereas the within-named Thomas Trubshaw being joint purchaser with the said Thomas Hopkin for some private reasons between them known, and whereas afterwards, viz. on the 10 May 1634, the said Thomas Trubshawe did by his deed dated the day and year aforesaid release to the said Thomas Hopkin all his estate and title which he had in all the within-mentioned premises, and that on 10 February 10 Charles I, the within-written Francis Steedman by virtue of a letter of Attorney dated 17 November to him and others given by the said Thomas lord Brudenell and Robert Huett, the said Francis Steedman delivered seisin to the said Thomas Hopkin, in the presence of : Thomas Steedman, Francis Steedman, Thomas Merryn.., his mark, John Right, his mark.
