Marriage Settlement between Robert Owterym of 'Wuddus' [Woodhouse], co. Derby, yeoman, and William Owterym, one of the younger sons of Robert Owterym of 'Wuddus', co. Derby, yeoman, to Robert Fentam of Barlow Woodseats, co. Derby, yeoman, where the said William shall, before the feast of the Nativity of St John the Baptist next coming, take to wife Elizabeth Fentam, eldest daughter of the said Robert Fentam, if the parties assent and the ecclesiastical laws will permit; and in consideration of the said marriage, the said Robert Fentam will before the feast of St Michael the archangel next coming grant to Edmund Stephenson of Gray's Inn, co. Midd., gentleman, Robert Coke of 'Colley' [Calow], co. Derby, yeoman, and Robert Swyft and Thomas Swyft of Barlow Woodseats, yeomen, the messuage dwelling-house wherein the said Robert Fentam now dwells and the lands pertaining to the same messuage in the towns and fields of Barlow, Barlow Woodseats and Dronfield, to hold to the use of the said Robert Fentam for life and, after his death, to the use as to one moiety or half to the said Elizabeth and her heirs, and in default of issue to Jane Fentam, and then to Agnes Fentam, the younger daughters of the said Robert Fentam, and then to the right heirs of the said Robert Fentam; and of the other moiety, to the use of the said Robert Fentam for his life and, after his death, to the use of Agnes Fentam, now wife of the said Robert, for her life, remainders as above; and the said Robert Owterym, for the preferment of the younger daughters of the said Robert Fentam, will pay to the same, at his mansion house in Barlow Woodseats, at the said feast day of St Michael, 1590, between the hours of 10 a.m. and 2 p.m., the sum of £25 each to the use of the said Jane and Agnes Fentam; and the said Robert Owterym will find, at his own costs, sufficient meat, drink and lodging for the said William and Elizabeth and their children at the now mansion house of the said Robert at 'Wuddus', if they are content so to do, during the life of the said Robert Fentam and Robert Owterym, and if the said Robert Owterym dies before the said Robert Fentam, then the costs will be borne by the latter; and if the said Elizabeth dies without issue, the said William Owterym shall not be entitled to enjoy the said mansion house for his life as tenant by the Custom of England, and the said Robert Fentam shall repay one-half of the said sum of £50 due to his younger daughters; and the said William Owterym shall permit Agnes Fentam, wife of the said Robert Fentam, and his daughters Jane and Agnes, if then unmarried, to occupy the said mansion dwelling-house for one year after the death of the said Robert Fentam, and if the said Robert and Agnes die leaving their younger daughters unmarried, then the said William will find them meat and drink at the said mansion dwelling-house of the said Robert Fentam until their respective marriages.
