Sale by John Fytzherbert, King's Remembrancer of the Exchequer, to John Port, husband of Joan, daughter of the said John Fytzherbert, and Joan Port his said wife, for the special love he owes to the same John and Joan, of all the messuages and lands which the said John Fytzherbert had in the towns of Etwall, Burnaston, Trusley and Hilton, for the sum of 300 marks, whereof the said John Fytzherbert has pardoned the said John and Joan £40, and the residue to be paid, as to 40 marks at the making of this indenture, and at the feast of the Nativity of the Lord Jesus Christ 1496, 2o marks, and within the space of 2 years next, 100 marks, and within another year, the residue of the said 300 marks; and that where the said John Fytzherbert has previously enfeoffed Walter Odeby and John Chauntrell, clerks, and Randolph Belyngton, the said John Port, John Copwode, John Yorke and John Yoman with the said lands, to hold to use of the said John Fytzherbert, now the said feoffees shall stand to the use of the said John and Joan and the heirs of the said John Port; but if the said John and Joan Port shall die without male heirs of their bodies, then if Eustace Fytzherbert [Fitzherbert], son of Henry, son of John Fytzherbert, has male issue, the said Eustace or the said male issue shall pay to the executors of the said John Port the sum of 240 marks remaining of the said sum and the said Eustace or his male heirs shall then have the aforesaid lands, with remainder to John Fytzherbert [Fitzherbert] of Norbury.
