DECRETALS, chiefly of Alexander III., and other canon and civil law collections, viz.:-
1. Brief fragment of the end of a tract on civil law, ending " Dig. pro suo, Si alienam." Quotes Bulgarus, Jacobus and Martinus. f. 3.
2. " Incipit summa de testibus magistri G." : a civil law tract. The interpretation of the initial seems doubtful. Preface, in which the writer speaks of " J. consobrinus nieus," beg. " Inter homines litium fata parit diffidendi naturalis facilitas," and text " De testibus hec sunt inspicienda .... Testis est ueritatis adiutor." f. 3 b.
3. A collection of legal maxims, mostly on the same subject. Beg. " Omnes hereticos infames esse." f. 9 b.
4. Decrees of the third Lateran Council held in 1179. The order of the articles does not correspond with any of the other MSS. (Royal 10 B. IV., 10 C. IV., Ar. 490) or with Mansi's Concilia (vol. xxii.). Imperfect at the beginning. f. 11.
5. Eight decretals (a later insertion), of which the first is assigned to Pope Innocent III., to whom also belong at least three of the others, viz., Potthast, nos. 698, 1324, 1403. Beg. " Dilectus filius noster abbas de Ferentillo." f. 16.
6. A compilation of decretals, probably put together in England under Lucius III. (1181-5), arranged -tinder fourteen tituli, of which the first is " De simoniacis et indebitis exactionibus tam in ecclesiasticis," etc., and the last " De Judeis, ne monachi a laicis uel clericis firmam teneant," etc. The first few chapters (only) correspond to the Leipzig collection described by von Schulte in the Vienna Academy's Sitzungsberichte, Phil.-Hist. Classe, Bd. lxxii. p. 491. Many of the letters are not in Jaffé's Regesta, and these are chiefly addressed to England. Beg. " Cum sit Romana ecclesia cui licet inmeriti." f. 18.
7. An appendix to the preceding article, containing thirty-five deci.etals on various subjects, ranging in date from Alexander III. to Clement III. (23 Mar. 1188). At the end, in another hand, is one (Jaffé, no. 17,055, anno 1193) of Caelestinus III. Beg. " B. Exoniensi. Illi qui animo occidendi." f. 96. Vellum; ff. 103. Early xiiith cent. Initials in colours. Belonged to William Shaw Mason (secretary to the Irish Record Commission, ob. 1853); afterwards purchased by Sir T. Phillipps from Payne the bookseller (Payne and Foss, cat. 1837, no. 9014). Phillipps MS. 11,726 (sale-cat. 1899, lot 33). Old binding of wooden boards covered with vellum. 10.25 x 7.5 in.
