COLLECTIONS, genealogical, legal, and historical. Sir Thomas Phillipps (see his Catal. Manuscriptorum under no. 3765, and Collectanea Topogr. et Geneal. vol. i, p. 20) regarded the collection as made by Robert Aske, whose name occurs several times. Internal evidence (see below, esp. art. 11) makes it almost certain that this is Robert Aske of Aughton, co. York, the well-known leader of the Pilgrimage of Grace, executed in 1537, but it seems impossible that he can have compiled the collection in anything like its present shape, since several items are of a later date than his death. The entries are very miscellaneous in character, and many different hands are represented; and it seems probable that the volume is the notebook of an anonymous herald or antiquary, with other entries perhaps concerned with the household of the Earls of Northumberland. That the collection into a single volume was made not later than about the middle of the 16th century is proved by old foliation in Roman numerals. This, entered on the back of each leaf, begins at the present f. 13 b (f. 1) and ends at f. 151 b (f. 127). Though lost or mutilated on some pages owing to the cutting of the pages by a binder, the numbers can for the most part be traced, and show that the original order of the leaves was substantially the same as at present. Between the present ff. 83 and 88 there was some confusion, the original order having been 83, 87, 86, 85, 84, 88. Ff. 84-87 were originally bound upside down; since the contents are at present in correct order and were certainly written before the volume was bound, the original order must have been a binder's mistake. After f. 76 of this first numeration the foliator skipped a number, passing on to 78. Between the present ff. 97 and 107 there was again an error in binding: ff. 106,107 were originally numbered 93, 96 and the original ff. 94, 95 were probably the present ff. 99, 102, where, however, the original numbers are lost. Ff. 127-139 were not in the volume as originally bound, the first foliation passing on from the present f. 126 (115) to f. 140 (116). At a slightly but not much later period the volume was re-folio'd with Arabic numerals and probably re-bound, the foliator taking account of ff. 6-12, not included in the first foliation. The order was, however, different from the present one, viz. ff. 12, 9, 7, 8, 11, 13, 14, 6, 10, 17, 18 (ff. 15 and 16 were not numbered), and the earliest extant number is 10, so that some leaves must have been included which are now lost. The second foliation agrees with the first in the order of ff. 83-88, but has the correet order for fr. 97- 107. No numbers of this foliation appear on ff. 127-139, but whereas f. 126 was numbered by this foliator 128, f. 140 appears as 138, and though f. 151 appears as 149, ff. 152 (containing merely the conculsion of an imperfect pedigree) and 154 are numbered respectively 166 and 162, f. 153 being unnumbered. It appears therefore that some leaves have been lost at the end. Though the first foliation begins at f. 13, f. 14 forms a single sheet with f. 8, the contents of which follow on from f. 7, so that these leaves must have formed part of the volume from the first. The volume was finally re-bound and arranged in its present order by Ralph Starkey (d. 1628) the antiquary, who added (ff. 1 b-5 b) an index of personal names contained in it and corrected or supplemented the second foliation where necessary. The papers certainly or probably connected with Aske are all (except art. 2) legal in character and appear to be notes of his studies in the law; he was admitted at Gray's Inn in 1527 (J. Foster, Collectanea Genealogica, x, 1883, p.19).Since most are certainly and all are possibly in a hand different from his, it is not clear how their presence is to be accounted for, and it might be suggested that some anonymous law-student had made use of Aske's name as a
prominent personality at the time; but this seems to be disproved both by the dates, which are earlier than the time of his notoriety, and by art. 2. Of these Aske papers only art. 11 was numbered in the first foliation. The contents of the volume are: 1. Forms of counts in law cases, each beginning "vous avez cy N. N.", dated 18 Henry VIII [1526-15271. They are not taken from the year-books and most closely resemble those in Novae Narrationes, where however the beginning is "ceo vous monstre N. N. que cy est." Two cases occur; in the second one of the parties is Robert Aske. Fr. f.7.
2. Account of expenses of [Henry Percy, 6th] Earl of Northumberland, headed "Memorandum that I Robert Aske seruaunt vnto the right honorable the Erle of Northumberland hath resauede of my said lord and master in the battelment aboue Sainte Stevens Chapell at Westmon. the xvijt day of May in the xixt yer off king Henry the viij [1527] as doth aper in the end C li" ; in the same hand as the preceding. Draft or copy of a petition to the King to issue letters patent granting to Thomas Hamerton for a year and a day the custody of the manor of Baterisby Hall and lands in Baterisby [Battersby in Ingleby Greenhoe], co. York, held of Stephen Hamerton; the custody having fallen to the King by the death of the tenant Richard Baterisby and the attainder of Nicholas his son and heir. A pencil note by Sir Thomas Phillipps on f. i states tbat the volume was bought at King and Lochee's in 1813 at the sale of the library of [left blank], esq., F.R.S. (lot 947). The purchaser was perhaps William Radclyffe, Rouge Croix (1803-1823), whose bookplate of arms is on f. i. Phillipps 318. 3765 (sale-cat. 1911, lot 47).
