HARDWICKE PAPERS. Vol. DXVII. Parliamentary collections temp. Chas. II., chiefly relating to the impeachment of Thomas Osborne, Earl of Danby, in 1678-9. Apparently collected by Sir Henry Capel, afterwards Lord Capel of Tewkesbury, who was manager for the Commons against Danby. The principal contents are:-
1. "Articles against [Edward Hyde] the Earle of Clarendon, late Lord Chancellor of England, together with the arguments Pro and Con in the House of Commons concerning his impeachment," 1667. f. 9.
2. "Two letters from Mr Montagu to the Lord Treasurer" [Danby], 11, 18 Jan. 167 7/8, with the "Lord Treasurer's Speech," 23 Dec. 1678. Printed, London, 1679. f. 45.
3. Minute of the judges' opinion on a petition [for pardon ?] from Lord Danby, with the following note in Capel's hand: "I made a clarke of the Councell give me this coppy out of the Councell booke of the opinion of all the judges deliuer'd by Judge Scroggs, I being then of the Councell and sitting therin in my place, 1680." f. 53.
4. Articles of the impeachment of Danby, with copies of minutes and precedents; 1678-9. f. 54.
5. Notes of proceedings in the House of Commons relating (a) to war with France, partly from the Journals, partly "as it was taken by a member of the House in short hand," 6 Mar. 167 6/7-29 Apr. 1678. ff. 83, 136, 160;-(b) to the case of Sir John Fagg, about privilege between Lords and Commons, 4 May-9 June, 1675. f. 114.
6. "His Majesties Declaration for the dissolution of his late Privy Council, and for constituting a new one"; 20 Apr. 1679. Printed. f. 185.
7. The King's Speech and the speech of the Lord Chancellor to both Houses; 30 Apr. 1679. Printed. f. 191.
8. "Severall loose papers bound up together relating to Parliamentary proceedings," rearranged chronologically, 1663-1679. At f. 229 is a paper in Capel's autograph, "Notes of the Kings answer to Lord Russell, Lord Cavendish and my selfe touching a Speaker, '79." f. 195.
9. Financial papers, viz.: (a) Amounts of the shipmoney of 1639 and other taxations. f. 238;-(b) "Tobaccoes entred in the porte of London in fower yeeres from Lady Day, 1637," endorsed as "taken out of my Lady Norwich [Alice, widow of George Goring, 2nd Earl,] her standish in the closett in that roome formerly called my Lord's dressingroome," 28 July, 1680. f. 247.
