The volume contains the documents related to the judicial process carried out between the Hermandad de Dolores [Fraternity of Sorrows] and Marta Subercaseaux between 1940 and 1946. The case refers to a discrepancy between both parties as a result of the inheritance of the husband of the aforementioned, Ernesto Zorrilla Larrain. The latter, in his will dated 1939, left as bequeathed 10,051 shares to the Fraternity with the life usufruct of them in favor of his spouse. Mrs. Subercaseaux, however, defended that she had the right to subscribe, pay and make them her own, to which the Instituto de Caridad [Institute of Charity] responded by presenting its refusal. The discussion ended through an agreement between both parties: the Hermandad de Dolores [Fraternity of Sorrows] will own the shares that will form part of a new issue carried out by Banco de Chile, recognizing to Mrs. Subercaseaux a portion of the dividends that they will produce throughout her life.
El volumen contiene los documentos relativos al proceso judicial llevado a cabo entre la Hermandad de Dolores y Marta Subercaseaux entre los años 1940 y 1946. El caso se remite a una discrepancia entre ambas partes a raíz de la herencia del esposo de la referida, Ernesto Zorrilla Larraín. Este último, en su testamento fechado en 1939, legó 10.051 acciones a la Hermandad con el usufructo vitalicio de ellas en favor de su cónyuge. La Señora Subercaseaux, sin embargo, defendió que ella tenía el derecho de suscribirlas, pagarlas y hacerlas suyas, a lo que el Instituto de Caridad respondió presentando su negativa. La discusión finalizó mediante un arreglo entre ambas partes: la Hermandad de Dolores será dueña de las acciones que formaran parte de una nueva emisión realizada por el Banco de Chile, reconociéndole a la señora Subercaseaux una parte de los dividendos que produjeran durante toda su vida.
