Appeal from the High Court of Judicature for the North-Western Provinces, Allahabad, between Raja Balwant Singh (Plaintiff) Apellant, and the Secretary of State for India in Council, through the Collector of Agra (Defendant) Respondent.
The appeal was refused and the application was dismissed with costs.
The appeal relates to the recovery of Rs. 4543, with costs and interest, as an alleged excess of irrigation rate paid by the appellant by mistake in respect of two villages, Gangi and Kaitha, of which he was the zemindar on 1885 and 1889 and which the Collector, on application, had refused to pay.
