- Title:
- Lawsuits between Coopers' Company and East India Company
- Scope & Content:
- In January 1837, the Coopers' Company wished to buy the lease of the saltpetre warehouse from the East India Company since the local gas company was interested in the premises. The East India Company, however, sought permission from the Coopers' Company to sell an underlease to Thomas Ward, who had put down a deposit on the property following a contract agreed in February 1837. The deposit had to be returned to Ward in May 1837 when the Coopers' Company refused to consider the grant of an underlease. The Coopers' Company believed that the East India Company was in breach of its covenant by the grant of a lease of land and two houses to David Trinder in 1773. A bill was filed in May 1837 by the East India Company in the Court of Chancery for settlement of the dispute. The case hearings spread over several years with a number of different actions involved: East India Company versus Coopers' Company; Attorney General versus East India Company; Coopers' Company versus East India Company; Attorney General versus Melvill; Attorney General versus Coopers' Company; East India Company versus Boyer [L/L/2/993-1146]. Actions were also begun in the Court of Queen's Bench: action of ejectment in the Queen's Bench: Doe on demise of Coopers' Company versus Roe [L/L/2/1147-1158]; action in Queen's Bench: Coopers' Company versus East India Company (action for rent) [L/L/2/1159-1170]. A settlement was finally reached in 1846 whereby the East India Company surrendered the lease to the Coopers' Company in return for a lump sum in compensation.
