- Title:
- Documents from Judiciary of Belém - Judgment of Law of the Capital - Box 18 c1859
- Scope & Content:
- Judiciary documents contained in Box 18. Document 1: Lino Antonio, “crioulo”/Creole, widower, an ex-slave and a freedman since 1859, filed a complaint against his former master Antonio Rodrigues Chaves. According to Lino Antonio, despite the fact that he and his wife, Nataria Francisca (deceased), were both freed, Chaves had been trying to convince him to return to captivity because he wanted to sell not only him but also his children (Maria José, Raimunda, Raimundo, and Benedito). The children were living with Chaves in the city of Bragança since the death of their mother Nataria. During the proceedings, Chaves claimed that Lino Francisco and his daughters Maria and Raimunda were fugitives and were hiding in different parts of the province along with other slaves of his property (Marcellino, Domingos, Zeferina, Nataria, Quiteria). Antonio Francisco Pinheiro, Guilherme Amasonas de Sá and Raymundo Clementino de Castro Valente, solicitors. João Diogo Clemente Malcher, judge. João Luis Peleja, scrivener. Document 2: Umbelina, Black slave, claimed that in the will of her deceased mistress, Teresa Ignacia de Jesus Fróes, there was a clause setting her free after paying ten years of service to José Raymundo Monteiro. In the copy of the testament, attached to the proceedings, it is possible to know that Teresa Fróes was single and had no direct heirs. The testament established that one of her slaves, named Rita, “mulata”/Mulatto, and her daughter, Celestina, were to be set free immediately. In the same document two other female slaves, Anna and Umbelina, were obliged to serve her nephew José Monteiro for ten years and set free after this time period. Teresa Fróes also freed of “all captivity” the following slaves: Bibiana, Antonia, Estevão, Francisca and Silvana (“mulata”) along with her two daughters (Maria dos Santos and Calistra Maria). “Little” Estevão were to be given to her grandmother and Juvencio (“mulatinho”) should go to Rita and her daughters. Marcelino Marques de Lima, scrivener. Document 3: Anna Joaquina filed a complaint with the court arguing that her daughter Catharina, “Cafuza,” was born from a “free womb” (ventre livre). However, Catharina was at that time held in captivity by Thomas Antonio de Sousa Madeira, a resident of the region bordering the river Curatuba, in the Igarapé-Mirim county, who wanted to re-enslave her. Antonio Paulino de Souza Uchôa, solicitor. Camillo José do Valle Guimarãens, judge. Marcelino Marques de Lima, scrivener. Document 4: Adrianno (“pardo”/Mulatto), declared before justice that his master, João Romão, had had a debt of 400,000 réis with Fernando Lopes de Azevedo. Romão had then assigned Adrianno to work for Azevedo as long as it was needed to pay his debt. Adrianno claimed that he had worked for Azevedo much more than established by the deal and solicited to be legally freed. Antonio Paulino de Souza Uchôa, solicitor. Marcelino Marques de Lima, scrivener. Extent of original material: Box (cardboard)24,5cm X 15cm X 36cm04 documents422 pages.
