Papers Relating to Lawsuits between Clanricarde and Joyce
- Scope & Content:
-
Case documents, correspondence, and disputed accounts relating to lawsuits between the second Marquis of Clanricarde (Hubert de Burgh Canning) and Francis Joseph Joyce.
[Francis Joseph Joyce left Clanricarde’s employment at the rent office at Loughrea on 19 February 1887. He brought a case against Clanricarde for libel following the publication of letters in ‘The Times’ and the ‘Standard’, in which it was stated that Joyce had informed Clanricarde of a no rent conspiracy amongst his tenants. Joyce denied this, stating that he had entreated a general rent abatement. Clanricarde brought a counter claim for alleged negligence in Joyce's management of his estates. Joyce was killed in an accident on 8 May 1890, and Clanricarde pursued his estate in the matter of compensation for errors in his farm accounts.]
Includes:
Copy extract of Registrar's certificate for Clanricarde to produce accounts; writ of summons of 30 April 1887; copy of Mr Atkinson's objections; and copy joint opinion of John Atkinson and Robert J Robertson of 23 May 1887 for trial in Ireland since ‘The Times’ and ‘Standard’ newspapers are circulating (items 1 to 5).
Various letters regarding rents, two marked as evidence: letter from J H Blake, Athenry, annotated 'very important' and explaining valuation and rentals of Meelick tenants (item 11); and letter from the rent office at Loughrea regarding terms for tenants (item 9).
Other miscellaneous letters regarding tenancies of 1895 and 1903.
Copy order to appear of Edward Tener of 4 May 1887 (item 13).
Correspondence from January to February of 1891 with advice from Robert Peebles, Solicitor, as to whether Clanricarde should pursue Joyce's estate for settlement of disputed farm accounts (items 14 to 19).
And correspondence regarding dispute as to expenses of examining and investigating accounts in Ireland incurred by Kean & Co. Letters from Robert Peebles verify accounts and vouch for the integrity of the company, and keep Clanricarde informed of threatened legal action (items 20 to 32).
