Contains legal documents and correspondence relating to the lawsuit brought by the Marquis of Clanricarde, Hubert de Burgh Canning, against Costelloe and Others in the High Court of Justice in Ireland, Chancery Division, and the appeal by Conry and Others in the House of Lords.
[In 1842 land had been leased to Roman Catholic clergy by the 1st Marquis of Clanricarde. In the late 1880s Reverend Patrick J Coen had joined with the Woodford Tenants' Defence Association in supporting their refusal to pay rent, and allowing huts to be built on church land to accommodate evicted tenants, the so-called 'Looscaun Huts'. A case was brought against Costelloe and others by Clanricarde to have these huts demolished. Conry appealed in the House of Lords and settled out of court.]
Legal documents include: statement of claim of 2 June 1890 to the High Court of Justice in Ireland listing tenants (item 6); and memoranda of January 1894 whereby the appellants, Conry and Others, agree to dismissal of the appeal, payment of £600 costs, and the removal of the huts (also at Blacksmith's Forge Acre) before 1 June 1894, and the respondent, Clanricarde, agrees not to enforce his rights (items 18 to 19).
The correspondence consists of: correspondence between Clanricarde and solicitors Charles Graham, Loughrea, and Peake & Co, London, including a letter from Frederick Peake of 2 January 1894 writing that the appellants’ solicitor has agreed to the appeal being dismissed with costs with time for removal of the huts (item 5); and a letter to Clanricarde’s agent Edward Tener in Loughrea from Charles Graham.
