- Documents from Judiciary of Belém - Judgment of Law of the Capital (Second Court and Civil) - Box 4
- Scope & Content:
- Judiciary documents contained in Box 4. Document 1: Constancio, slave, 50 years old, petitioned emancipation from his master, José Domingues dos Reis Sobrinho, and produced the amount of 500,000 réis for this end. Antonio Francisco Pinheiro, solicitor. Arminio Adolpho Pontes e Souza, judge. Marcelino Marques de Lima, scrivener. Document 2: Amelia ,‘Carafusa’ (Cafuzo, Black/Indigenous mixed blood), slave of Archangela Maria da Conceição, and her daughter Francisca, slave of Archangela’s daughter, Joanna de Pinho, claimed that for not being enrolled in the Emancipation Fund they were entitled to be legally freed. Carlos Hyppolito de Santa Helena Magno, solicitor. Felippe de Souza Uchoa, judge. Marcelino Marques de Lima, scrivener. Document 3: Francisca, 55 years old, slave, claimed that her deceased master, Angelo Custodio Correa, and mistress, the Baroness of Cametá, wished to free her before their deaths and she can provide several witnesses. Nonetheless, their daughter, Joanna, has kept Francisca in captivity. Augusto Carlos de Moura L’Encastre, solicitor. Marcelino Marques de Lima, scrivener. Document 4: Isabel Maria da Silva, slave, claimed that she had not been enrolled in the Emancipation Fund neither by her deceased master, captain Manoel Antonio Rodrigues, or by his heirs, which was against the Law of 1871 and, for that, she petitioned to be legally freed. Samuel W. Mac Donald, solicitor. Marcelino Marques de Lima, scrivener. Document 5: Domiciana, 35 years old, slave, resident of Carmelio, in the Acará county, said that her daughter, Hilaria, a freed woman, has given her 300,000 réis to buy her freedom from João Alves de Menezes, her master. However, for being in jail, she petitioned the magistrate to appoint a curator to deal with the legal proceedings to free her from slavery. There is a transcription of the list of all slaves pertaining to Menezes that were enrolled in the Emancipation Fund, detailing slave’s name, color, age, marital status, place of birth, parents, work aptitude, profession, and observations. Raymundo Borges Leal Castello Branco, solicitor. José Quintino de Castro Leão, judge. Marcelino Marques de Lima, scrivener. Document 6: Albina Maria da Conceição, African (born in Luanda, Angola), single, 30 years old, “branded with a hot iron on the right breast, with the form of an I,” had been held as slave by a certain F. de Figueiredo, despite the fact that she had been freed as soon as she arrived from the Coast of Africa. This situation was brought to the attention of the Portuguese consul in Belém, Joaquim Baptista Moreira, by the school teacher José Maria de Sá Dias Lamego. Lamego presented a very interesting letter written in Albina’s name that contains a narrative of her enslavement in Angola, the middle passage, the ship capture, her arrival in Rio de Janeiro, her emancipation, travel to Pará, and life in Belém. The Portuguese consul wrote then a letter to the president of the Province of Pará, Francisco Maria Correa de Sá e Benevides, denouncing the case and asking for a solution. Document 7: Francisco Ribeiro, slave, deposited 800,000 réis that he had received from his aunt Joanna Theodorica to buy his emancipation. However, being in jail (Cadeia Pública) by order of the Chief of Police and his master Anastacio de Souza Monteiro Cardoso, he could not deal with the legal proceedings and petitioned the magistrate to appoint a solicitor for the case. João Francisco da Cruz, solicitor. José Quintino de Castro Leão, judge. Marcelino Marques de Lima, scrivener. Document 8: Bonifacia, Black, blind (medical report attached), slave of João Ferreira Dias and his wife, was promised to be freed against the payment of 200,000 réis. However the agreement was not fulfilled by her masters despite the fact she had the necessary amount. Bonifacia can provide witnesses of her masters’s promises. Raymundo Borges Leal Castello Branco and Lourenço Rodrigo Freire da Motta, solicitors. Antonio Bezerra da Rocha Moraes, judge. Marcelino Marques de Lima, scrivener. Document 9: Quiteria Maria da Conceição and her son Raymundo (minor), both slaves of André Cursino Gomes, for not being enrolled in the Emancipation Fund requested the nomination of a solicitor to carry on their case in order to be declared legally free. Tiberio Augusto Freire da Motta, solicitor. Arminio Adolpho Pontes Sousa, judge. Marcelino Marques de Lima, scrivener. Document 10: João de Deos, slave, claimed that his master, Hermenegildo Pereira Lima, did not enrolled him in the Emancipation Fund for which he should be bestowed with a certificate of emancipation (carta de liberdade), except for the “direitos dominicais” (Sunday rights) conceded to his master by law. João de Deos requested the magistrate to issue a “mandado de manutenção de liberdade” (“maintainance of freedom act”). Marcelino Marques de Lima, scrivener. Document 11: Laura, Black slave, denounced the heirs of the late Isabel Ovidia de Resende for bringing her to Belém to be sold without a valid certificate, since she had not been enrolled in the Emancipation Fund by them. Such fact entitled her to be legally freed. She feared her master’s violent behavior and asked for urgency in the process because they wanted to sell her outside the Province. José Leoncio Braga, solicitor. Marcelino Marques de Lima, scrivener. Extent of original material: Box (cardboard)24,5cm X 15cm X 36cm22 documents874 pages.
